Flashback! DEVIN NUNES CALLS FOR IMMEDIATE ARREST OF JOHN KERRY FOR TREASON

Remember how they accused Flynn of violating the Logan Act? Yeah, that’s what this is, except Kerry is actually breaking the law. Flynn was part of the government as an elected official advisor. Kerry has no business undermining our country. That is sedition and he can go to jail.

Former Secretary of State (and failed presidential candidate) John Kerry has been engaging in shadow diplomacy, virtually in violation of the Logan Act.

Kerry is working with foreign leaders in order to keep the disastrous Iran nuclear agreement in effect. The world now knows, as proven by Israel and confirmed by the U.S., that Iran is not following through on their end of the deal.

President Trump warned former Secretary of State John Kerry to “stay away” from Iran negotiations ahead of his crucial Tuesday afternoon announcement, where he will reveal whether the U.S. will preserve the Obama-era nuclear deal with Tehran.

The president’s tweet comes as he prepares to tell the world his administration’s plan for the future of the Iran pact. Ahead of a May 12 deadline, Trump tweeted that he would make the announcement at 2 p.m. ET on Tuesday.

He is widely expected to re-impose sanctions, a move that could unravel the agreement, but has not yet said publicly what he will decide.

The president’s latest swipe at Kerry comes amid reports that the former secretary of state had meetings with foreign leaders in a bid to save the deal, practicing what Trump has called “possibly illegal shadow diplomacy.”

“John Kerry can’t get over the fact that he had his chance and blew it! Stay away from negotiations John, you are hurting your country!” Trump tweeted early Tuesday.

Now the chairman of the House Permanent Select Committee on Intelligence is calling for former Secretary of State John Kerry to be the very first person ever arrested under a constitutionally dubious 1799 law.

Congressman Devin Nunes (R-CA) made his demand to imprison the former Massachusetts Democrat under the Logan Act, which could theoretically result in three year in federal prison.

Here is the text of the Logan Act:

§ 953. Private correspondence with foreign governments.

Any citizen of the United States, wherever he may be, who, without authority of the United States, directly or indirectly commences or carries on any correspondence or intercourse with any foreign government or any officer or agent thereof, with intent to influence the measures or conduct of any foreign government or of any officer or agent thereof, in relation to any disputes or controversies with the United States, or to defeat the measures of the United States, shall be fined under this title or imprisoned not more than three years, or both.
This section shall not abridge the right of a citizen to apply himself, or his agent, to any foreign government, or the agents thereof, for redress of any injury which he may have sustained from such government or any of its agents or subjects.

Who has the authority?

Article II, Section 2, Clause 2 of the United States Constitution includes the ‘Treaty Clause,’ which empowers the President of the United States to propose and chiefly negotiate agreements, which must be confirmed by the Senate, between the United States and other countries, which become treaties between the United States and other countries after the advice and consent of a supermajority of the United States Senate.

[The President] shall have Power, by and with the Advice and Consent of the Senate, to make Treaties, provided two thirds of the Senators present concur…

In United States v. Curtiss-Wright Export Corp., 299 U.S. 304 (1936), Justice Sutherland, writing for the Court, observed,

“[T]he President alone has the power to speak or listen as a representative of the nation. He makes treaties with the advice and consent of the Senate; but he alone negotiates. Into the field of negotiation the Senate cannot intrude; and Congress itself is powerless to invade it. As Marshall said in his great argument of March 7, 1800, in the House of Representatives, ‘The President is the sole organ of the nation in its external relations, and its sole representative with foreign nations.’

I say throw Kerry in jail. Now beyond what Trump may have done..for Kerry to interfere with a seated president’s international communications is a high-level crime.
